These Terms and Conditions ("Terms") govern your access to and use of the Bookami mobile application ("App") and any related services provided by Bookami ("we," "us," or "our"). By downloading, installing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Description of Service

Bookami provides access to a curated digital library of books sourced primarily from Project Gutenberg and similar public domain archives. Through the App you can discover, read, and track books, organize personal bookshelves, monitor your reading progress, and manage a personal library — all at no charge.

2. Public Domain Content & Copyright Notice

This is one of the most important sections of these Terms. Please read it carefully.

2.1 Public Domain in the United States

The books available through Bookami are believed to be in the public domain in the United States of America, meaning their copyright has expired under U.S. law. Bookami does not own the copyright to any of these works.

2.2 Copyright Laws Vary by Country

A work that is in the public domain in the United States may still be protected by copyright in other countries. Copyright protection periods differ significantly between jurisdictions — for example, the European Union generally extends protection to 70 years after the author's death, while other countries may apply different rules or have signed treaties that extend terms further.

2.3 Your Responsibility

It is your sole responsibility to verify that your use of any content available through the App — including reading, downloading, reproducing, or distributing it — complies with the copyright laws applicable in your country or region before doing so. We make no representation or warranty regarding the copyright status of any work in any jurisdiction outside the United States.

2.4 No Warranty of Public Domain Status

We disclaim all liability arising from your use of content in jurisdictions where such content may still be protected by copyright. If you are located outside the United States, you use this content at your own legal risk.

2.5 Copyright Infringement Reports

If you believe any content in the App infringes a valid copyright in your jurisdiction, please contact us at [email protected] with details of the work and the claimed infringement. We will investigate and take appropriate action.

3. User Accounts

—Sign-in: You may create an account by signing in with your Google or Apple account. By doing so, you authorize us to access the profile information provided by those services as described in our Privacy Policy.
—Accuracy: You agree to provide accurate information and to keep your account details current.
—Responsibility: You are solely responsible for all activity that occurs under your account, including any unauthorized access you fail to report promptly.
—Age: You must be at least 13 years of age (or the minimum digital age of consent in your jurisdiction) to create an account.
—Termination: We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:

—Reproduce, redistribute, sell, or commercially exploit content from the App in jurisdictions where that content remains under copyright protection.
—Use the App for any unlawful purpose or in violation of any applicable local, national, or international laws or regulations.
—Attempt to gain unauthorized access to any part of the App, its servers, or any database connected to it.
—Use automated scripts, bots, scrapers, or other means to access or harvest content without our express written permission.
—Interfere with, disrupt, or overburden the App's servers, infrastructure, or the experience of other users.
—Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
—Impersonate any person or entity or misrepresent your affiliation with any person or entity.
—Transmit any material that is harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.

5. Your Library & Reading Data

Your reading progress, bookshelf organization, reading status (Reading, Completed, Want to Read), and library data are stored on our servers to provide a seamless experience across devices.

You retain ownership of your reading data. We may use aggregated, anonymized data — which cannot identify you — to understand how readers use the App and to improve our service.

You can delete your account and all associated data at any time through the App's settings. See our Privacy Policy for details on data retention.

6. Content Accuracy & Availability

Books sourced from Project Gutenberg and similar archives are digitized historical texts. They may contain OCR errors, formatting imperfections, or missing sections that reflect the quality of the original digitization. We are not responsible for such inaccuracies.

We do not guarantee that the App or any specific book will be available at all times. Titles may be added or removed from the catalog, and access may be interrupted for maintenance or technical reasons.

7. Intellectual Property

The Bookami name, logo, app design, and all software, features, and non-book content are owned by us and protected by applicable intellectual property laws. These Terms do not grant you any right to use our trademarks, trade names, or other proprietary material.

The public domain book texts are not owned by us. Nothing in these Terms restricts your use of those texts beyond the copyright considerations described in Section 2.

8. Third-Party Services

The App integrates with Google Sign-In and Apple Sign-In for authentication. Your use of those services is governed by Google's and Apple's respective terms of service and privacy policies. We are not responsible for the acts or omissions of these third parties. Additionally, book texts are sourced from Project Gutenberg, a project of the Project Gutenberg Literary Archive Foundation.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the App is at your sole risk.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Bookami and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or relating to your use of or inability to use the App, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the twelve months preceding the claim (which, given the App is free, shall be zero).

11. Indemnification

You agree to defend, indemnify, and hold harmless Bookami and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App, including but not limited to any infringement of copyright or other intellectual property rights in your jurisdiction.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through the App or by email to the address associated with your account. The updated Terms will display the revised date at the top of this page. Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms. If you disagree with the changes, you should stop using the App and delete your account.

13. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If that fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Germany.

14. Miscellaneous

—Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bookami regarding the App and supersede all prior agreements.
—Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
—Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
—Assignment: You may not assign your rights or obligations under these Terms. We may assign ours without restriction.
